{"id":557,"date":"2020-05-27T12:24:16","date_gmt":"2020-05-26T23:24:16","guid":{"rendered":"https:\/\/peneloperidings.com\/wp48\/?p=557"},"modified":"2020-11-05T09:46:56","modified_gmt":"2020-11-04T20:46:56","slug":"arbitrating-trade-disputes-what-does-the-future-hold","status":"publish","type":"post","link":"https:\/\/peneloperidings.com\/wp48\/index.php\/2020\/05\/27\/arbitrating-trade-disputes-what-does-the-future-hold\/","title":{"rendered":"Arbitrating Trade Disputes: What Does the Future Hold?"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"557\" class=\"elementor elementor-557\" data-elementor-post-type=\"post\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-68b6f374 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"68b6f374\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-2a766f6c\" data-id=\"2a766f6c\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-287e394a elementor-widget elementor-widget-text-editor\" data-id=\"287e394a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In August 2019 I presented a paper at the Annual Conference of the Arbitrators&#8217; and Mediators&#8217; Institute of New Zealand on the future of arbitrating trade disputes.\u00a0 It was for a New Zealand audience which wasn&#8217;t very familiar with the WTO dispute settlement system.\u00a0 So it explored the background to the creation of the WTO dispute settlement system and the functioning and criticisms of the WTO Appellate Body.\u00a0 I took a New Zealand perspective in identifying the gains and deficiencies of the WTO dispute settlement system and looked at various potential pathways to resolving the current impasse.<\/p><p>One of these was what is now the Multi-Party Interim Appeal Arbitration Arrangement.\u00a0 I said at the time that it remained to be seen whether other WTO Members would sign onto such an approach.\u00a0 Clearly WTO Members, including New Zealand, have done so.\u00a0 This is a strong indication of New Zealand&#8217;s commitment to the WTO dispute settlement system and its confidence that the system will continue to deliver benefits to WTO Members as it has in the past.<\/p><p>The full text of the paper is available at: Ridings, Penelope, Arbitrating International Trade Disputes: What Does the Future Hold?
